DMCA Copyright Policy

NXONDECK's copyright infringement policy and safe harbor procedures under the Digital Millennium Copyright Act.

Overview
NXONDECK respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, NXONDECK will respond expeditiously to claims of copyright infringement and will disable access to infringing content upon receiving a valid DMCA takedown notice.
NXONDECK qualifies for the safe harbor provisions of 17 U.S.C. § 512(c) because it: (1) does not have knowledge of specific infringing activity; (2) does not receive financial benefit directly attributable to infringing activity; (3) acts expeditiously to remove infringing material upon notification; and (4) has designated a copyright agent with the U.S. Copyright Office.
Repeat Infringer Policy
Pursuant to 17 U.S.C. § 512(i), NXONDECK maintains a policy of terminating the accounts of users who are repeat infringers. NXONDECK uses a three-strike system:
  • Strike 1: Written warning sent to DJ. Set removed. Infringement logged.
  • Strike 2: 30-day streaming suspension. Second warning issued. DJ notified of termination risk.
  • Strike 3: Permanent account termination. All content removed. Appeal available within 30 days.
Strikes reset after 12 months of no DMCA violations. Counter-notices that result in restored content do not count as strikes if the underlying claim is found to be without merit.
Requirements for a Valid DMCA Notice
Per 17 U.S.C. § 512(c)(3), a valid DMCA takedown notice must include all of the following:
  • A physical or electronic signature of the copyright owner or their authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material claimed to be infringing and its location on our platform (URL)
  • Contact information of the complaining party (name, address, phone, email)
  • A statement of good faith belief that the disputed use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and the complaining party is authorized to act

Counter-Notice Requirements
Per 17 U.S.C. § 512(g)(3), a valid counter-notice must include:
  • The subscriber's physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that the material was removed by mistake or misidentification
  • The subscriber's name, address, phone number, and consent to jurisdiction of the federal court
After receiving a valid counter-notice, NXONDECK will forward it to the claimant. If the claimant does not file a court action within 10–14 business days, NXONDECK will restore the removed content.
Response Timeline
  • 0–2 hours: Acknowledge receipt of notice
  • 2–24 hours: Review notice for completeness and validity
  • Within 24 hours: Remove/disable access to infringing content (valid notices)
  • Within 24 hours: Notify the affected DJ with takedown details
  • Upon counter-notice: Forward to claimant within 24 hours
  • 10–14 business days: Restore content if no court action filed
